General Terms and Conditions

Registration

By registering for the RCS Systemsteuerungen GmbH affiliate program (“rcs-shop.de Affiliate Program”), you agree to the following Terms of Use.

RCS Systemsteuerungen GmbH reserves the right to update and change the Terms of Use from time to time without prior notice.

Violation of any of the terms below may result in termination of your account and forfeiture of any outstanding affiliate commission payments earned during the violation.

Account Terms

You must provide your full name, a valid email address, and any other requested information to complete the registration process.

You may not use the Affiliate Program for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction (including, but not limited to, copyright laws) when using the Service.

You must not misrepresent the relationship between us and you in any way or claim that you are developing our products.

Links / Graphics on your Website, in your Emails or other Communications

Once you sign up for the Affiliate Program, you will be assigned a unique affiliate code. You are authorized to place links, banners or other graphics that we provide to you with your affiliate code on your website, in your emails or in other communications.

Commissions and Payment

In order for a referral commission to be paid on a product sale, the customer must click on a specific link from your website, email or other communications targeting rcs-shop.de or cocut.com and complete an order for a product during that session.

We only pay commissions for links that are automatically tracked and reported by our systems. We do not pay commissions when someone indicates they have purchased something or when someone indicates they have entered a coupon code if this has not been recorded by our system.

We reserve the right to disqualify commissions obtained through fraudulent, illegal, or overly aggressive questionable sales or marketing methods.

Customer Definition

Customers who purchase products through this program are considered our customers. Accordingly, all of our rules, policies, and operating procedures regarding customer orders, customer service, and product sales apply to those customers. We may change our policies and operating procedures at any time. For example, we set prices for products sold under this program in accordance with our own pricing policies.

Term of Agreement and Program

The term of this Agreement begins when we accept your Program Application and ends when terminated by either party. Either you or we may terminate this Agreement at any time with or without cause. Upon termination of this Agreement, for any reason, you will immediately cease using any links to rcs-shop.de or cocut.com and remove them from your website, as well as all of our trademarks, trade dress and logos, and any other materials provided to you by us or on our behalf pursuant to this Agreement or in connection with the Program.

Relationship of the Parties

You and we are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.

Limitations of Liability

We will not be liable for any indirect, special or consequential damages (or for loss of revenue, profits or data) arising in connection with this Agreement or the Program. In addition, our total liability arising under this Agreement and the Program shall not exceed the total amount of commissions paid or payable to you under this Agreement.

Jurisdiction

The place of jurisdiction for all disputes arising from this contractual relationship for both parties is the local court of Trier.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN.
